Terms of use of the service.
Scope and acceptance
These terms govern the use of AGENXIA, a service by Ideas en Axion that combines artificial intelligence agents, appointment scheduling, a client portal and the publication of the business website.
By contracting or using the service, the business accepts these terms. If it uses the service on behalf of a company, it states it has the authority to bind it.

What the service includes
Automated handling of questions over the enabled channels (WhatsApp and web), using the information the business loads.
Booking appointments in the business real calendar, registering customers, notices and handover to a person when needed.
Administration panel and portal for the business owner, with usage and demand metrics.
In the plans that include it: a public business website with online booking.
Plans, prices and billing
Current plans and prices are published on the site and in the commercial proposal. Prices are expressed in US dollars unless stated otherwise.
The service is billed in advance and renews for equal periods unless the business cancels before the renewal date. Setup or onboarding services, when they exist, are billed once.
Non-payment allows us to suspend the service after a notice. While suspended, the agent stops answering and the published website may go offline.
We may update prices. Changes are notified with reasonable notice before the next period.
What the business commits to
Loading truthful and up-to-date information about its services, prices, opening hours and promotions, and reviewing it periodically: the agent answers with what the business gives it.
Holding the right to use the WhatsApp number and the channels it connects, and complying with Meta and platform policies.
Processing its customers’ data in accordance with the law, informing them of its privacy policy and handling their access or deletion requests.
Not using the service to send unsolicited communications (spam), unlawful or misleading content, or for activities forbidden by law.
Keeping its panel and portal credentials secure.
Messaging channels and third parties
The WhatsApp connection depends on Meta Platforms and on your number conditions (official Cloud API or QR linking). AGENXIA does not control and cannot guarantee the availability, approval or continuity of those conditions.
With QR linking (unofficial channel), heavy or automated use may lead to restrictions by WhatsApp. The business understands and accepts that risk, and AGENXIA is not liable for blocks or restrictions imposed by third parties.
Before activating the service we review with the business which alternative fits its case.
Artificial intelligence: scope and limits
The agent answers with the information loaded by the business. It is not a professional adviser nor an emergency service and it can make mistakes or misunderstand a question.
The business is responsible for the information it loads and for the commercial decisions it makes. AGENXIA is not liable for wrong answers caused by outdated or incomplete information loaded by the business.
The system supports handover to a person when a question requires it; the business must handle those handovers.
Availability and support
We work to keep the service continuously available, with scheduled maintenance that is announced when it implies a relevant interruption.
We do not guarantee uninterrupted or error-free availability: the service depends on infrastructure, power and connectivity providers.
Support is provided over the channels informed at the start of the relationship.
Intellectual property
The platform, its code, its trademarks and its developments belong to Ideas en Axion. The business receives a non-exclusive licence to use it while the service is active.
The content the business loads (texts, photos, prices, logos) remains the business’s property, and the business authorises AGENXIA to use it only to provide and display the service.
Personal data
Data processing is governed by the Privacy Policy. For the data of the business customers, the business is the controller and AGENXIA is the processor.
When the service ends, the business may request an export of its data.
Limitation of liability
To the extent permitted by law, AGENXIA is not liable for indirect damages, lost profits, data loss or interruptions caused by third parties, force majeure or by incorrect information loaded by the business.
AGENXIA total liability towards the business is limited to the amount actually paid for the service in the three months before the event.
Nothing in these terms limits the rights the law grants to consumers when the business contracts as a final consumer.
Term, suspension and cancellation
The service is provided in periods and renews unless cancelled. The business may cancel at any time with written notice; the current period is not refunded.
We may suspend the service for non-payment, prohibited use or security risk, with notice when possible.
At the end, we unpublish the business website and keep the data available for export for 30 days, unless a legal obligation requires keeping it.
Changes to these terms
We may update these terms for service or legal changes. We publish the date and version, and notify the registered email address when the change is substantial. Using the service after the notice means acceptance.
Governing law and jurisdiction
These terms are governed by the laws of the Argentine Republic. Disputes are heard by the competent ordinary courts of the City of Buenos Aires, unless the law provides another forum for consumers.
